IP Address and Device Information

For your protection and ours, we record your IP address and device information (browser type) when you perform certain actions on our platform. This includes:

  • Submitting a booking inquiry or lead form
  • Signing your service agreement/contract

  • Approving, declining, or requesting changes to design templates

This information serves as a digital record of your actions and consent, similar to a notarized signature. It helps prevent fraud, resolve disputes, and creates an audit trail for legal and business purposes. Text Messaging (SMS)

ATX Photo Booth offers an optional SMS photo delivery service at live events. This service is entirely voluntary — you are not required to provide your phone number to use the photo booth.

How consent is collected: After your photo is taken, the photo booth iPad displays a sharing screen. If you choose to receive your photo via text, you physically type your mobile phone number on the iPad touchscreen. Before sending, the following consent language is displayed on-screen:

"By tapping Send SMS, you agree to receive a one-time text with your photo. Msg & data rates may apply."

By tapping the "Send SMS" button, the guest provides express consent to receive a single text message. No phone numbers are pre-loaded, auto-filled, or collected without direct input and affirmative action by the guest.

  • You will receive one (1) text message containing a link to view and download your photo.
  • We do not send marketing messages, recurring messages, or share your phone number with third parties for promotional purposes.
  • Phone numbers are encrypted using AES-256-GCM before storage and are used solely for photo delivery.
  • Message and data rates may apply depending on your carrier and plan.
  • Reply STOP to opt out of any future messages.
  • Reply HELP for assistance.
  • Compatible carriers include all major US carriers. Carriers are not liable for delayed or undelivered messages.
  • Text messaging is powered by Twilio.

Photo Usage

Photos taken at events are shared directly with your guests via SMS or email based on their consent at the time of photo capture. We may use anonymized or general event photos for promotional purposes on our website or social media, but we will always request permission from the event host before sharing identifiable images publicly.

Template Design Ownership

The custom photo overlay/template designs created by ATX Photo Booth remain the intellectual property of ATX Photo Booth and may be used for marketing, portfolio, and promotional purposes.

Third-Party Services

We use trusted third-party services to help operate our business:

  • Twilio: For sending photo delivery text messages at events
  • CheckCherry: For booking and reservation management
  • Google Analytics: To understand website usage and improve our services
  • Stripe: For secure payment processing. We do not store credit card information. Stripe's privacy policy.

Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet is 100% secure.
